You will need to provide an address for him so he can be servedOnce you obtain a judgement in small claims, your best bet is to file an Abstract of Judgement in the county the property is located.

You can require the ss# on a separate application, but then that number doesn't get verified. so good luck collecting on a judgement if it ever comes to that.

This would be so easy to throw out via a motion for summary judgement to dismiss with prejudice, the defendants attorney could literally motion the court right away pointing out the contract, response time was breached, etc. and a judge would immediately throw the suit out with prejudice (cannot be filed again).I don't know why this is such a big thread/some are giving bad advice to convince their lawyer.

You can likely get a judgement and maybe can garnish wages if they manage to find and keep steady employment at some point and don't file for bankruptcy.

If she has an 800 credit score, she may move to protect her credit score: make sure she knows that her score WILL BE TRASHED if she has an eviction and a judgement and that you are moving to a payment system where you can start IMMEDIATELY reporting late pays.
