Those included the wrong party conducted the foreclosure (the note and mortgage got separated and owned by two different entities) improper notices, gaps in the chain of ownership in the mortgage/note etc.So if you are buying a REO or outbidding the bank, the former owner can bring a suit claiming improper foreclosure but must do so in three years.

You can work out whatever payment arrangement you want, if any, but having someone local that has the stated authority to enter the premise on your behalf and conduct check-ups, move-in/out inspections, etc will go a long way to helping your sanity level.

If it went toward the purchase price, No, it's an asset.If you didn't buy the property and lost it, it's a deposit expense in conduct of business, so yes. :)
