Kyle Meyers,I didn't bother to chime in after Charles Perkins put his correct reply in.The interest goes on the property for which the interest occurs.

I am just not comfortable at all with the situation.I was thinking of adding a clause where the sellers do not get all proceeds from closing and a certain amount was held back in escrow for any default damages that occurred or extra days needed before they moved out.

Also, if I want to do a "subject to" deal with someone that is facing foreclosure, but the auction has not occurred, can I still attempt to buy the property directly from the owner if the numbers work for me?

I assume you start in the court division where the interpleader filing occurs.

I read something about if this occured, the other wholesaler can't try and sell it b/c it would be protected even in the computer system.

Does the motivated seller due to fatigue occur in the Multi's the same way that they do in the SF's?
