You only loose your deposit 100% if you sign a cancellation and release the deposit to seller but if you truly believe that you did everything you could to comply with mortgage contingency clause and lender did not fund due to their incompetence or because someone in their lending department dropped the ball then it's not your fault.

I am needing some opinions and suggestions I have a gentleman who is still on title to his house and believes his house has been foreclosed on its been vacant for over 5 years the tax lien is pending but I cant find any information through the county sites  about a foreclosure on this property even did a title search on fiverr  (for the time being not an actual title co I was told sometimes the bank drops the ball and don't foreclose on some homes he is reluctant to call the bank.

Fast forward a couple of weeks, for some reason (I don't know the details) the seller increased the price 40K and the contract fell through as the poential puyer low balled back.
