The challenge is how do we get the property into the investors name since we can't assign the PSA to, or instruct the closing agent to convey title to, the investor.

If this is not the case, you can instruct your closing attorney to prepare a deed that transfers the property into the LLC as part of the closing package.

You'll need to bring certified funds from your bank made out to the title company, they will give you the instructions.

Here is the sequence.1) The house is a shortsale, so the house needs to be listed (per bank's instruction).2) The listing agent accepted wholesaler's offer, waiting for the bank to approved.3) The listing agent never bothered to change the status on the Multiple Listing Service (MLS) to "Under Contract", so it still says Active.4) Shortsale approved at a great price (say $40,000) .  

Scenario 2) If I assign a contract to an investor for a $5,000 assignment fee and I instruct title to pay Joe Blow (the person who gave me the lucky lead/tip) out of my assignment fee (ie.

The landlord should have given you a specific set of instructions on what they expected.
