If this is the case, then the tenant cannot legally terminate the lease or indefinitely withhold rent.On the other hand, if the report does state a danger, then the landlord may be in breach of habitability.

You sell the property and using the 1031 process you purchase new investment real estate and get to indefinitely defer all tax and depreciation recapture.

@Edwin Rajkumar There is difference in definition for both borrowers but  in you case sister is not going to occupied the the property so above guidelines applies.

It could be argued that you agreed to store these items indefinitely by the simple fact that they're still there.
