I'd give written notice to my agent and theirs if you're using agents, if not then have the seller sign acknowledging they received your notice to cancel the deal.

That being said, I agree with you in theory, but do you have anything in writing that shows they acknowledged signing a twelve month lease despite knowing about 11-month orders.

She was sent both a rejection saying her business didn't qualify and and acknowledgement of receipt of her application.
