The borrower can file bankruptcy but then the property is tied up in bankruptcy and would need court approval for the sale - it will take several months to get the initial plan approved then several months to get it approved for saleIf it comes down to that you are better off buying it at auction.The last option is to take a huge risk and reinstate the loan but as mentioned without a title you have no clue what else could be owed- to do that would be foolish  So what’s a typical time frame to to get a loan reinstated with a title check?

From reading this post Ive just Decided to break into my home depending what my attorney tells me on the next court date 2 weeks from now i have already spent 4000$ on attorneys and nothing as been resolved so i will have to to do things my way i suppose since nothing is being done thanks,

Here's the deal:- Asking: 240k- Current mortgage balance: ~100k- Rehab needs: 40k- Value after reno: ~350k (I own the house next door and it was appraised at that after renos)Talk to a mortgage broker and ask them if they prefer a Wrap to refinance or a Subject To to refinance and at what LTV & seasoning before assuming 12 months will be enough time.1) A Wrap is where you have an attorney write a new loan to the seller for eactly the same terms and conditons he has with the lender.
