It seems like Wagner is just a broker and the issue is with the builder who isn't performing? 

Shop around and find something that works for you.

Other thought is sell our home that I did a live in flip and build a home with a detached shop. 

It is also likely that property insurance nation wide will increase substantially.Hopefully investors are performing conservative underwriting.

@Leon G. whether or not you decide to go fsbo or use a realtor you'll need to use a QI to perform the 1031 exchange for you if you want to tax on the gain from your sale (and depreciation recapture).
