I think I have figured out why we do not qualify for the STR loophole and why my accountant keeps saying we would not get any money back if we front-end depreciated the home: I have a property management company in place.

Get with a title company in your ares that closes these type of transactions.

While going through the HOA document I saw that the HOA secretary and president are from the company that purchased the complex from the original developer.

Your insurance company will work the other units insurance and the condo master policy to determine who should pay what, then they'll get it fixed.
