Due to a pending lawsuit against the HOA from a fire in 2014 the condo currently does not qualify for traditional financing.  

The next day, the property was taken down from Zillow and added to Realtor (it wasn’t there before) and listed as pending.

First I would research the properly thoroughly and make sure there are no liens/lawsuits pending.

Some counties/cities have “pending” liens such as for code violations that are Not recorded but can be found with the proper letters of inquiry to the proper departments....costs probably a couple hundred more for this type of title search.

Some websites will show a note as sale pending but I have never ween anything like an RE contract.  

The home that we are renting is in foreclosure, the bank foreclosure is pending.

I have chatted with Ben once as we both own investment properties in the same town as we were both at a city meeting about the pending zoning changes and how it would impact us as he lives a few miles away on the beach in the next town over.

That is why title co.s do "city/county unrecorded lien searches", which require a process involving written inquiry to the city/county regarding unrecorded/pending liens.
