I personally encourage all BoA sellers to serioulsy consider an alternative to a short sale like bankruptcy since they encourage promissory notes and will file deficiencies whenever possible.

It might get sticky as the bank may say they want the whole loan paid off after notice of demand, but your position is (and that of the owner) is to reduce his liability and possible deficiency amounts and the bank will have to show that they will be in a position with that one unit, that's a hard thing to prove!
