It says this is in the wholesaling forum so I assume you are a wholesaler.Attorneys can and will sue for opportunity loss on behalf of the seller.Does your contract say that the only remedy in full is forfeiture of the buyers earnest money as liquidated damages??

About $150k over budget wrong...with everything from a chimney suspended in mid-air to mold remediation and extensive termite damage (all of which could have ben avoided with better up-front diligence).

I think the risk of having it installed wrong concerning water leaks is way less than a shower base, and could usually be remedied in some way.

They also don't try to get me to change the conclustion of a study (deeper footings than they initially budgeted, remediation of previoulsy unknown existing fill material, piers instead of a slab, heavier retaining walls, etc) just so construction costs will be lower.
