He's currently being prosecuted by the DOJ for bank fraud too.I'm leaving out contextual details to keep this short, my question is: if a buyer wants to borrow $3.25m to buy a $4m property without showing financials, and they have $3.25m in an account with Bank A, could that be used to induce a $3.25m mortgage from Lender B?

The concealment itself is an indication of fraud (also if your not changing the insurance to person occupying the house you both have are not covered and likely committing insurance fraud) I assume you are not calling the bank and informing them of the transfer and they are just choosing not to use a due on sale clause.Are you likely to be prosecuted for this highly unlikely, it doesn’t change the fact that almost any misrepresentation on a federally backed loan is bank fraud, so much so that there are plenty of cases where the fed’s can’t get someone on a bigger charge so they hit them with bank fraud just to get a conviction because it’s so easy to prosecute.
