@Chris Da I can't give you any advice on the legal end of this, but I agree with @Kyle Samuel on this one, learn from your mistakes and set your contracts up differently now to cover your self for next time this happens.

I bet she will have to "get back to you".I would get a statement from the notary that he/she never notarized the document.Then I would get a copy of the brother's death certificate and a statement from the owner that he never signed the documents.Take those documents to the DA and see if they will help.
