Mind you, I'm not a lawyer, but the Civil Code specifically refers to this in a number of places.As for Will's comment about the broker involvement, he is correct in that if the broker arranges the deal, it will be exempt from the usury law.

If you are using a standard PAR agreement of sale, after 180 days if there is no dispute (subject to litigation or mediation) the escrow broker can return the Buyer the funds. if there is a dispute, the broker will hold the escrow until there is a written agreement or final court order. i had this issue early in my career and I put 30 days instead of 180

The new PMC in their lease agreement states that they would do an initial move-in inspection, however due to them receiving previous tenants from a lease agreement, when they took responsibility of the property, I do not think that happened either.My question is can I file a civil lawsuit against the previous PMC.
