It is only effective because the title company is in bed with the lenders already and they are naturally risk adverse anyway.I would be more concerned with the disclosures made to the lender and the verbiage of the approval letter before I considered a double close with two seperate title companies.For instance, does the B buyer have to agree that there are no prior or pending transactions or agreements and sign prior to closing?

MAny judges see damages as usual and customary as well as expected business expenses, natural wear and tear is subjective, but normal wear was probably considered with haveing a dog on premises, after all, 5 years and a dog there with your knowledge.
