You'd have responsibility of it.But if you wanted to play hardball I guess you could claim it's outside the scope, but I think if it went to court you'd lose based on inspection and other work items..You could always try to ask what kind of resolution the tenant is seeking and then maybe come to a compromise.

I missed the part that you are seeking a commercial loan. 

What kind of returns are you seeking out of state @Jacob Rascon?

Replace "I think we want hard money" with "We are looking for hard money because . . . "  Or what ever funding option it is that you are seeking. 

There could be a co-insurance penalty or the loss settlement might be actual cash value if you are not rebuilding. 

@Jeff Piscioniere I tried seeking partners for a multifamily purchase, join some REI groups, even posted in the marketplace here but couldn't find anyone in my area.   

Some have hefty pre-payment penalties and other rules.
