@Jake Stuttgen start with a review of all the recorded docs against the property which will appear in a title search--Declaration, By-Laws, Amendments, etc.

You need to look at property rights, adverse possession, easement by prescription laws as since the fence has been there that long and she and previous owner  have been maintaining that property for as long as they have,  they may already have rights to it, just need to declare it legally before the neighbor does anything. 

If you have not been declaring depreciation every year on your rental property you are literally flushing money down the toilet.

Various local Realtors organizations have petitioned local state real estate licensing boards to declare "wholesaling" to be illegal without a real estate license.

You could argue anticipatory repudiation, in defense, if needed…You would want to include an exhibit to your complaint demonstrating the tenants intent, in writing, and supply a very detailed and complete declaration. 

However, generally speaking, a Bankruptcy Trustee can declare a specific debt as non-dischargeable through bankruptcy due to "Fraud" on the part of the Debtor.
