Hello,  I am currently working to repair my credit, save for a downpayment, and increase my income with the initial goal being to own properties starting with a multifamily property in which I will occupy for 2 years.I came across a property that I love and I really don't want to let it get away from me because of the above stated challenges.My question is, do I have any other options other than waiting, like hard money lenders or seller financing options, that would get me the building while I am remedying my credit and income challenges.Also, the property is occupied, I believe one of the two apartments.

Well, the Central VA realtor contract states that either defaulting party is open to "all legal remedies allowed by law" in addition to the other party's damages, And is responsible for the Realtor fees, just as if it had closed.

While you avoided the restriction, it seems generically the remedies that may be available to you will place you in violation of the restriction moving forward.So obtaining a second lien for the rehab funds or even modifying the loan documents to comply with the spirit of the loan you thought you were getting don't seem like viable options.

Try to find an agent with an affiliate contractor or do the leg work yourself to choose a licensed GC....you won't have much of a window for remedy, so you need a scope of work drafted quickly to make your final "go, no-go" decision.
