Move now or get evicted and get your credit ruined and an eviction on your record - both of which will pretty much ruin his ability to find a decent rental in the future.And print out this article to hand to him, too:http://homeguides.sfgate.com/apartment-eviction-me...I'd tell him he needs to be out by a certain date (maybe a week?)

Needless to say, those that take advantage have ruined it for everyone else.I would consider making an addendum to the lease agreement that states the garden is okay, but charge them extra every mont for it and state that you as a landlord have no liability or responsibility for it or what happens to it.Also, they must remove once they move since they are responsible for it.

And if you don't find out until they move out, and their deposit isn't enough to fix the ruined floors...I think addenda, even if they're just informative, regarding mold and bedbugs and pest control, etc., are a good idea.
