Even if the tenant has the motivation to begin the lawsuit process, they quickly realize that the court fees / attorney fees would cost much more than their deposit, and even then, they'd likely lose their case.Also, think about the type of person this tenant is--do you really think that they have the intelligence, motivation, and perseverance to navigate the court system?
