I've done these deals and we have been able to renegotiate price and terms late in the deal, all while my client's EMD is fully protected either based on an inspection period or based on lack of disclosure.

We also had a specific end clause to the lease at the end of the 3 year period so the tenant would be forced to relocate or renegotiate at the end of the lease.Our tenant ended up passing away half way through the lease.

Blackstone literally just dumped Broadway office and dared the banks to try to do it better, they did try to renegotiate I believe.
