I have PERFECT payment history on this property (and EVERY OTHER DEBT) and pay the taxes, insurance and $2,000 a month HOA Fees - this is ALL prima facia evidence that I am paying this debt too - she is just not cashing the checks.

I was told by a judge (JP actually, they do our evictions in TX) to "nail and mail", that is attach one in an envelope to the front door, send one certified-return receipt and send one regular mail.BTW, not signing for a certified letter is NOT PROOF that it was not received, it's "prima facie" proof that it WAS, this from the same JP!

You've got 30 days from when you receive notice from the state to fix the problem, and if you don't, you can be charged with a Class A Misdemeanor and provide for a prima face case for negligence against you.As a landlord, that right there is some pretty scary stuff.

IE two deed changes same day as prima facia evidence the one party did not own it did not have the ability to close it and they actually went on to talk about it being some sort of fraud.. we did not get into it past that.So I see Nar and other local RE boards starting to jump on it and encourage their licensees to file complaints when they see someone acting as an unlicensed agent.
