I agree with Robert here, this is a very unlikely scenario. 

Dean, I agree with @Chris Ayars, I would cement bricks around the window well to raise the area around the opening and then get a window well cover that could go over top of the opening.

If I offer a pure investment than it does not have the same appeal.I came by an investment model used in another country where the investors were able to receive an interest during the construction time but could down the road could add the necessary capital and buy a condo in a presell price.

The majority of contracts are written up that way to be owner friendly, as long as both parties do what's agreed upon.
