If you're in a deal with another GP the percentage interest should be disclosed.

Something to keep in mind is all of these entities must submit a report to FinCen by the end of this year disclosing their Beneficial Ownership Information which includes the personal identifiers of the person behind the entity.

You either have it or you don't, if you borrow it you need to disclose to the bank where it came from

If they now know of items within the home that can affect the desirability they must disclose that (I assume thats the same in Florida). 

@Ori Skloot unfortunately, no one will be able to tell you whether you are paying too much because no one will openly disclose exactly what they had going on.$4,200 seems high but I don't know what was included in the scope of work.

But you are right, it comes with risks and all those risks are disclosed and I take those risks as an investor where I think it makes sense. 

It's a tough situation to be in but it is a known issue so you'd either have to disclose or fix before selling.  

We put a two week funding approval clause in our contracts that allows some time to market the deal, as well as give us time to renegotiate if there's a lien or title problem that was not disclosed to us from the seller.
