The cap you pay is a function of the area of the property, rent growth annually, the size of the property, and the tenant base among many others.

If  you have proper sized and sloped troughs and properly sized downspouts and the gutters are clean and functioning properly, there is no reason that water should be coming off your roof onto his.

I would also send the landlord a notice to cure lease violation that they are to pay for water in a timely fashion keeping this utility functioning.
