I did not read the rules around security deposits. you may be allowed to use those funds and still file a small claims action for any remainder, but I can't imagine that it would be worth it if you have at least one month's rent in security deposit.

this is a specific need you have and maybe there are attorneys here on BP in NY that can help, but having worked with jurisdictions before - with it being early december - these officials do not move very quickly so hopes of closing before year end could be complicated.
