Lawyer did some digging and found out the landlord: 1) failed to disclose where our security deposit was  (in which bank, etc), 2) the basement was being used as a bedroom and the landlord did not have permission to use it as a bedroom and 3) The fire inspection by the fire department was due for months even before we moved in.

It does not require tenant permission and it does not require the tenant to be present.

In a perfect situation, the payment will still be delayed (even if by hours) using this additional system.And secondly, many of these vendors have "clawback" provisions where, in their terms of service, you give them permission to go back into your account - even weeks after the fact - and reverse a deposit that was made by your tenant. 

Now my lease says that landlord has permission to use tenants power for maintenance and repair on the property.

Much easier to record a document and let the owner come to you and buy out your interest.Good luck. out our way recorders wont record a lot of these hey I have an interest in this property without the sellers written permission..

@Michael Williams The simple fact that you claim a bank needs your permission to sell/assign your mortgage, and it’s illegal for them to do it without your permission,  discredits anything else you claim.

The family states that pit bull will not live at the property but with a family friend.In the lease agreement it is clearly states “ Pets are not allowed to reside in the Premises, unless written permission is granted by the Landlord before the pet is moved in, which permission may be granted or withheld in the Landlord’s sole and absolute discretion.

We could use our own application and it was faster to get results since they don’t make any phone calls.In both cases the tenant signs permission or us to check data on the application, we fax it in, and they e-mail us back the results.

I had my prospective tenants pay for their background checks/credit checks through smart move directly, that way they are giving you permission to view their history, and you don't have to deal with an application fee directly.Hopefully this is helpful!
