I'm not sure if there is an agent involved with this transaction, but there is a form called "AMENDMENT TO CHANGE CLOSING/POSSESSION DATE" This form will provide you the most protection if signed by both parties.

A third feature that some have, but not all, is you can sometimes also cap the value of the burner numbers, so for instance, you can use a particular card number for a vendor in which you expect there to be no more than $50 a month in cost, and set a cap of $75 on it to limit your exposure if that number is compromised by anyone in the chain of it's possession.

Contingencies should include: inspections over a specific number of days (note the plural on inspection so that if you want to walk the property with contractors in addition to an inspector, you can do so.Financing - not just the ability to acquire it but the get an interest rate that is acceptable to you - which is normally defined as the prevailing rate for a defined mortgage (fixed, ARM).4 point/Insurance - note that an acceptable 4-Point is required for the engagement of insurance; should you not be able to get insurance on the open market, you can cancel with your escrow returned.Vacant Possession - require the property be free from trash/personal items/tenants - and/or any commitment to rent the property - on the day of closing to be verified by a final walk of the property by Buyer.There's more but these are the ones that I recommend every contract should contain.

I've instructed the servicer not to cash the check.The contract for deed states that if at any time the borrower is more than 30 days past due, I can call the entire loan due immediately and obtain possession of the property.Question: What would you do in this situation?

If that works, get it in writing but don't pay until they are gone and relinquished possession. 1K is a LOT cheaper than an eviction and not as combative a situation.

Look for the North Carolina Association of Realtors Seller Possession after closing form.Seems like there is a form for almost every situation, so you don't have to create one.
