I include a clause in my lease:ABANDONMENT: If during this lease, Agent believes in good faith that Tenant(s) have abandoned the premises and current rent is unpaid, Agent may re-enter the premises and remove the remaining possessions of Tenant(s) without liability, unless not allowed by local ordinance.

Just reiterate that the non-refundable reserve fee was paid to hold the unit, and you lost other potential tenants while you kept it off the market in good faith that they would be leasing the property.
