We do 1 or 2 year leases on all our properties so yeah, it does take some faith that they'll stay together for that long.

IMHO, every good landlord and property manager would prefer tenants adhere to the terms and conditions of a lease agreement, but when they do not, an eviction is a necessary tool.But don't mistake, while a notice is a something every landlord should be comfortable doing at the drop of a dime, an eviction, especially in a place like San Francisco, should only be performed with the assistance of a qualified and experienced landlord attorney.With all that said, there are many things that a landlord can do on their own and communicating with good faith and without the help of an attorney will help you become a more experienced and successful landlord and investor.

Probably not worth it, depending on how much the deposit was.I wouldn't see the judge saying you did anything in bad faith, since you gave them a copy of the laws and their lease, showing them you were in the right - so, if Alaska has a penalty for bad faith, I don't see you incurring that.If it was me, I'd wait to see if they did actually sue me.

If the contract was executed in good faith on your end and you just now discovered the problem the start date would potentially be the date of discovery.

Then, you show up in court and show the judge that the seller acted in bad faith, which I'm hoping you can prove with some documentation they provided saying this tenant had paid, etc.
