Also, even though you may have to return the full deposit due to a technicality, you should still be able to put them in collections and/or seek a judgement.Honestly, I would try to find a win/win.

@Guillermo Nadal I would say its premature to put this one in the win column wouldn't you say? 

Bottomline is that you are unlikely to "win" a suit against the city and even if you did, the legal costs would be very high.
