Personally, I'd do it "off the books" - I'm sure there's some obscure law by which one or both of you could be held liable for fiduciary breach, SEC violation, etc.

Here we go into a bit of an obscure topic...My understanding is that a UTMA account is a way to transfer money into a minor's name so the minor can later use it for education or other purposes.
