You can't get a conventional mortgage to rent a property out.Unless I misunderstand and that isn't what you're referring to. 

I had a misunderstanding to the problem as my experience with divorce was practically none, essentially the court was trying to split everything they had, and the judge took the ZESTIMATE + the rental income for the house and that's what she assessed it as.

As you, in my opinion pushed your responsibility onto the tenant to contact the HVAC company and there is no indication you spoke with the HVAC company prior I think any misunderstanding is on you.
