This may not be for you (since you are not doing a 1031 exchange), but I will say for others that if pressed on time in your 1031 replacement search, a DST (Delaware Statutory Trust) is a last-minute option for many.

I would go with the 1st option, but it's going to be hard to press someone in court to pay the bill because they can say they did not use that much utilities, without sub-metering, you would not have any proof on who used more than the other tenants, but for the most part tenants will pay it.I guess if you wanted to stipulate in the contract that the lower unit would pay for the entire building you could, it's a contract after all..

YOU can't do anything. except write up a unauthorized tenant living in unit as lease infraction. that will either be remedied by adding the new person on or booting everyone in the unit.The police won't force the new roommate out.Check landlord tenant laws for your state and comply with that.As long as current tenant gave access to the unit, it's the tenants problem not yours unless you press the unauthorized tenant issue.. as far as my experiences have shown.

Add in the student debt, baby boomers looking to move to urban environments and other pressing reasons for apartments, you have pretty sound logic.I will let a lender speak on the financing issues, but don't forget to look at the avenue of investing in projects being built, passively.
