Your lease, which requires that the new tenant's rent be applied to the vacating tenant's balance, seems unnecessarily complicated in my opinionIn the future, you might consider adding language to your lease that implements an "early-termination fee." 

At this point, you're playing with House money (almost no pun intended) in Durham -- it would be a shame to prematurely cash out unnecessarily. 

There have been multiple maintenance/repair expenses that seem excessive/unnecessarily repetitive...

But don't contribute unnecessarily to the system which is ruining people in the exact manner which is disconcerting to you.Just one man's opinion :)

I agree Account Closed, reducing equity can provide protection of the asset from a lawsuit, but increases risk unnecessarily if this is the only reason to leverage.

sure. but that is not what she is confronting and it does no good to unnecessarily scare her. 

Here is what the lease says: Tenant shall not be permitted to, and shall not permit any family, visiting friends, dependents, guests, licensees or invitees of Tenant to grow, produce, possess, consume, use, smoke, or ingest any marijuana, cannibas or any products or ingestibles containing marijuana or cannibas in any location in, on or about the Premises; the foregoing prohibition to be absolute and without exception and shall include any growing, production, possession, use or consumption pursuant to any medical use or medical prescription, or any medical, retail or recreational marijuana activities that may otherwise be permitted under any local, state or federal laws, rules or regulations now or hereafter in effect.

You are running a business, and when you are making exceptions, you are subjecting yourself to problems unnecessarily.  

It takes about 5-10 minutes of local records searching to find your address unless you have unnecessarily complex series llcs set up.
