I basically have a 3 stage EMD where one half of the EMD is paid after DD is complete and the other half is paid after financing is approved out of underwriting and it goes hard the day after that payment is made.

And let me say for the record, I've been looking for case law on this very point for quite some time after stating my distaste for the idea that a licensing authority can limit a person's ability to act as POA for the purpose of selling a property, and I have found nothing in any of the Circuits.What I would tell Clients, were I in a draconian jurisdiction that practiced such things, is the cost of going through the appellate process, likelihood of succeeding at the appellate stage, and a breakdown, like you said, of whether it is worth pursuing.
