A Grant Deed warrants or assures a certain condition of title that is insurable for a sale to a 3rd party buyer.In the big picture, it may be easier to think of probate as a title matter.

@Steve Babiak Over 6 years the inspector probably cost me $10K for things that were not warranted or because he insisted they were owner responsibility when it was caused by tenant damages.

While a Special Warranty Deed, will at least warrants something, excluding those specific issues stated, if it used as a deed in lieu of foreclosure, in most states there is no recourse for the lender in accepting any deed as full payment of the obligation, so even if some issues were warranted, enforcement is not available.

I have a hard time believing that the EPA can just walk on your property and take samples without a warrant or a complaint of some sort.
