Technically if you decline based on information provided by a Consumer Reporting Agency (IE credit report, background check, etc) you have to give them an Adverse Action notice (SmartMove can provide this for you if you use them) which will state where the applicant can investigate further and dispute the information.I tell applicants simply: "We have received your application and unfortunately it does not meet the qualifications for this property."

If there is an EM dispute, the broker can get a Deposit Dispute Resolution order from FREC, and distribute the EM accordingly.

All of the offers I received on my first flip I'm selling having been requesting Home Warranty to be included.I've read that some drawbacks include: Unpredictable response time; too many clauses/exclusions that providers can use to deny claims (drawn out process to dispute); you're using their contractors only; and it's up to them whether something gets replaced or repaired.I'm sure there are people that have saved tons of money using home warranties.

The city is know to be Tenant favorable for Landlord/Tenant disputes, to the extreme, unless it is a part of the city.

There is more to selling the property than looking at a few comps.If you move forward with it w/o an agent, make sure you understand the "appraisal" dates and deadline under line 87 (section 3.1) in the Contract to Buy and Sell Real Estate, as that leaves the buyer a resolution or possible out if the appraisal comes in under ask price.Have the sellers share the comps they used to price it.Have the sellers pay for an appraisal before going under contract.
