The judge literally laughed when I handed him a binder with photos, each receipt, each description of the damage, and the tenant-signed final-walk-through report.Still, it took me several months to fix the place back up and get the judgement.

I have a rule of thumb to pursue legal matters with tenants and I figure I'll share it;1) Am I right (sometimes I make mistakes and I dodn't pursue)2) Do I have over a 50% chance of winning (I can be right, but still have a decent risk of loss)3) Do I have over a 50% chance of collecting (I can get a judgement, but does the person have money)In the case below, you would likely meet 1 and 2... but 3 can get tricky.

If you go that route you can get a judgement for lost rent and collect if they are collectible.

I am by no means trying to be dogmatic, I only operate outside of grey areas when funds from IRA money are involved and encourage others to do the same.I certainly would not want to be on the losing end of an IRS judgement to tax the IRA for flipping, would you?

the cool part in the 12 states for home owners is that there is no Deficiancy judgement allowed on a purchase money loan form a third party.. the sole remedy of the lender is the property.
