Depending on certain factors, there may be an easement by prescription at this point, and even if there wasn't you can't just take a chainsaw to your neighbors property if it's encroaching.The advice about having your own guy come out & make sure your roof's water stays off his and then lawyer up when the time comes is spot on.

It does suggest that the tenant must be "disabled" and the ESA must help with that disability.I am fairly convinced that the letter by the physician does not establish "disability".
