As a mortgage lender I can’t really speak from the tax benefit angle, but if we purely talking future qualification, it’s typically better on a schedule E because certain write offs can be added back into bottom line.

If a new tenant started to do what you are asking, it would be a violation of my lease and I would likely require that person to be added to the lease, or a new lease to be drafted up.

Make sure it's filled out correctly.They are simply putting the deposit against a month.Now, when they phone up to complain after seeing the notice, tell them that court costs will be added, so by Friday they already owe you more money than you currently hold.

I also have a clause (lifted right out of Bigger Pocket's The Book on Managing Rental Properties thank-you-very-much) about anyone staying longer than 14 days is someone who needs to apply and be added to the lease if they meet the requirements etc…My worry is that the company will pay the rent, have this one person on the lease and then will cycle 'visitors' through the property essentially as a short term hotel.

Since the OP is in Texas, it is really of little consequence as to whether legal fees can be added or not if the judgement cannot be collected.
