When wholesaling a contract, and you do not have an entity and you plan on assigning the contract do you put your name on the contract as buyers, and at closing the attorney uses the assignment of contract to close in the right name. or do you leave the buyer section blank and when the contact is assigned the attorney puts the assignee's name on the buyer's line in the contract?

In some areas it is considered fraud for you to run the background checks just to keep an application fee if you know other factors have already disqualified them.Stated a different way... once you get to the point where you run the credit, eviction and criminal checks, if you disqualify them it had better be for something you found out or confirmed from those not something like their income was not high enough or the were argumentative or left blanks on the application or any other reasonable factor you knew, or should have known, before you ran the checks.

Make notes of such issues and address them with your attorney in drafting the OA.I think for the cost involved, getting a blank form OA isn't really a value, I suspect much of it defaults to state law and won't allow the flexibility that can be devised that later on can save you thousands.
