If you just had a boundary survey done and not the full ALTA that could be way it wasn't noted.If your title company also issued Title Insurance you would then go back to them and they will need to dig into that further to see how they missed it and what the remedies are.

All the first floor flooring was up two months after the new build and after mediation won and had the developer put in french drains, epoxy remediation for the slab, and new flooring/mold remediation, etc.
