Make sure the siding is at least 8 inches above grade, ensure that there is no untreated wood in contact with soil or foundation, check any exposed studs for damage, check any exterior trim/sills that come close to the ground, etc.Also, certain areas of the country are more termite prone than others.

Putting a few small nail holes in a wall is ordinary; putting four lag bolts into a wall or 100 staples into the window trim is not ordinary.I have no idea where your investment is, so I can't give you State-specific assistance.

Unless the property owner had been given notice about a defect related to the tree, or if he/she/they happened to be out there trimming the tree or something when it happened, the owner will not be found liable.
