The only downside to naming both, is that it can cause you more to sue more than one person/entity, because of being charged for more than more defendant and/or address.The next most beautiful thing about suing people in small claims court, is that you don't have to know what you're doing and you don't have to pay for a lawyer.Most judges in small claims court are lawyers who basically do it as a part-time side job.
