It seems quite harmful to both the seller and the buyer, but great for the agents. 

As you said, not a concern if you have a PM - we work with Uptown Properties - but the complexity of following the "rules" and the harm that can be inflicted on your business if you mess it up has always made me scared to do anything w/o a PM (plus I'm out of state, so forget it).
