John Smith IRS Foreclosure Redemption Likelihood? ~$1.3M Equity, ~$2M+ Federal Tax Liens

Overview:   - The senior lienholder (lender) – first deed of trust – is foreclosing on the property (no HOA or property tax liens) and the IRS and other judgements (state income tax, credit cards) are junior to the senior lienholder (deed of trust)   - Lender Bid for Auction: ~$550-600k   - Market Value of Property: ~$1.6-1.9M   - IRS Federal Tax Liens: ~$2M+   - Other Liens (state income tax, credit cards): ~$90k+ (a couple are senior to IRS’ Federal Tax Liens but all are junior to lender who is the senior foreclosing lienholder)With the amount the IRS is owed I’d imagine this is a higher visibility tax lien case for them, and may in turn have a higher probability of redemption but would welcome thoughts and feedback on the likelihood of the IRS actually redeeming?

This has been a bigger issue with the immigrant population being issued numbers.I have had to request that the applicant send me a copy of their card and then make a judgement call on whether the card is legitimate or not.

The court "likes" this better than the judgement, takes away the fight with the attorney and gets you the possession back.Sometimes the tenants don't show and you win right away - yes, that still happens.In the end, @Nathan Fisher is right on, you need a good attorney.

I do agree with Nathan that many tenants will just break a lease because for an "average tenant" its difficult to collect on judgements so no amount of early termination fees etc in a lease will make you whole.

Then you can apply the deposit to any damages when they leave and the remainder (if any) can be applied to the judgement

Of course you can sue and you will probably win, but after you consider attorney fees, court costs, your time away from your business, etc and the real possibility you will never collect on a judgement.... is it worth it?
