(Fred Mertz).Hopefully she has the money and it's not one of those "I can make the grey sky blue, I can make it rain whenever I want it to" type of stories to buy time.Hopefully she doe not try to give you a partial payment, (having never had the full amount, or having spent some of the cash on lottery tickets and cigarettes the night before).Understand what rights to evict you might screw up if you take a partial payment.Good Luck!

I am also going to be speaking to the condominium complex manager tomorrow about the situation and ask questions about the previous owner.Again I have done just about everything I can in regards to repairs and working with my tenants who have been great in terms of paying rent on time and have responded to all of my messages in regards to minor complaints from the neighbors (things like cigarettes flying out of the area and such).

There’s plenty of signs no one is living there currently and there is spoiled food in fridge and ash trays on beds with old cigarette buds in it.

I'm allergic to cigarette smoke, so I feel for your tenant.I don't think that clause you referred to will have any impact on this since smoking is legal, and this would open an enormous can of worms if this went to court.There's only one solution I see, and that's to buy the unit below and either flip it or rent that one out too (after clean up) if the complex allows for it to be a rental.
